Service Charge Evidence Checklist for Tribunal Preparation

Most leaseholder challenges fail. Not because the charge was reasonable — because the evidence was incomplete.

The First-tier Tribunal (Property Chamber) expects a complete picture. Challenging a service charge requires documentary evidence that demonstrates why a charge is unreasonable, why consultation procedures were not followed, or why the service standard fell below what was paid for.

Incomplete evidence is the single most common reason leaseholder challenges fail. Not because the charge was justified, but because the leaseholder could not prove otherwise.

This checklist covers the seven categories of evidence you need to gather. Use it as your preparation roadmap.

The seven evidence categories

1. Lease and title documents

  • Your lease and any variations or side letters
  • Official copies of the freehold title from HM Land Registry
  • Schedule of reserved services and maintenance obligations

2. Service charge demands and accounts

  • All demands for the period in dispute
  • Annual service charge accounts (certified if possible)
  • Budget vs actual comparison for the relevant years
  • Previous years' accounts showing the charge pattern
  • Evidence of payment (bank statements, receipts)

3. Consultation and statutory compliance

  • Section 20 consultation notices (for major works or long-term agreements)
  • Estimates and tenders obtained during consultation
  • Your written observations submitted during consultation
  • Section 20B notice (if the landlord plans to recover costs outside the normal year)
  • Landlord's certificate of compliance with consultation requirements

4. Budgets and financial breakdowns

  • Annual budgets for the disputed period
  • Invoices and receipts for specific costs being challenged
  • Management fee agreements and invoices
  • Insurance policy schedules and premium invoices
  • Third-party supplier contracts (cleaning, maintenance, etc.)

5. Meeting minutes and correspondence

  • AGM and EGM minutes where service charges were discussed
  • Committee minutes relating to budget approvals
  • All correspondence with the landlord or managing agent about disputed charges
  • Written queries and responses under your right to inspect documents
  • Copies of any formal complaints made

6. Photographic and inspection evidence

  • Photographs showing condition of common parts, services, or equipment
  • Reports from independent surveyors or contractors
  • Fire risk assessments and EICR reports
  • Records of any inspections carried out

7. Comparative evidence

  • Quotes from alternative suppliers for comparable services
  • Service charge levels in similar buildings in your area
  • Industry benchmarks where available

How to organise your hearing bundle

The tribunal expects a bundle organised in logical order with numbered pages and an index. Each document should show the date, author, and relevance to the case.

  • Use a consistent naming convention for electronic files
  • Include a table of contents with page numbers
  • Highlight key passages in each document that support your case
  • Prepare a chronology of events covering the dispute timeline
  • Include a witness statement from the leaseholder or committee member with direct knowledge
