1. Introduction

These Terms of Service ("Terms") govern your access to and use of the LeaseholdConnect platform ("the Service"), operated by LeaseholdConnect ("we", "our", "us"). By creating an account or using the Service, you agree to be bound by these Terms.

2. Eligibility

You must be at least 18 years of age and have the legal capacity to enter into a binding agreement to use the Service. By using LeaseholdConnect, you represent that you meet these requirements.

3. Account Registration

When you create an account, you agree to:

  • Provide accurate and complete information
  • Keep your account credentials secure and confidential
  • Notify us immediately of any unauthorised access to your account
  • Accept responsibility for all activity that occurs under your account

4. Use of the Service

LeaseholdConnect provides tools for leaseholders associations to manage their operations, including member management, meeting scheduling, voting, and document storage. You agree to use the Service only for its intended purposes and in compliance with applicable laws.

You must not:

  • Use the Service for any unlawful purpose
  • Upload malicious software, viruses, or harmful content
  • Attempt to gain unauthorised access to other users' accounts or data
  • Interfere with or disrupt the Service or its infrastructure
  • Use the Service to harass, abuse, or harm others
  • Scrape, data-mine, or automatically collect data from the Service

5. Subscriptions and Payments

LeaseholdConnect offers free and paid subscription tiers. For paid subscriptions:

  • Fees are charged on a per-unit, per-month or per-year basis as described on our pricing page.
  • Payments are processed securely through Stripe. We do not store your full payment card details.
  • Subscriptions renew automatically unless cancelled before the renewal date.
  • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
  • We reserve the right to change pricing with 30 days' notice. Existing subscribers will be notified before any price change takes effect on their account.

6. Free Trial

We may offer a free trial period for paid features. At the end of the trial, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends. We will remind you before the trial expires.

7. Your Content

You retain ownership of all content you upload or create on the platform ("Your Content"), including documents, meeting minutes, and association records.

By using the Service, you grant us a limited licence to store, process, and display Your Content solely for the purpose of providing the Service. We will not use Your Content for any other purpose without your explicit consent.

8. Data Protection

We take your privacy seriously. Our collection and use of personal data is governed by our Privacy Policy, which forms part of these Terms. By using the Service, you consent to the practices described in the Privacy Policy.

9. Disclaimers

Not legal advice: LeaseholdConnect is a management tool, not a legal service. Any information, templates, or content provided through the platform is for informational purposes only and does not constitute legal, financial, or professional advice. You should seek independent professional advice for specific legal matters relating to your lease or association.

Service availability: While we strive to maintain high availability, we do not guarantee that the Service will be uninterrupted, error-free, or available at all times. We may perform scheduled maintenance with reasonable notice.

10. Limitation of Liability

To the maximum extent permitted by law, LeaseholdConnect shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising from your use of the Service. Our total liability for any claim related to the Service shall not exceed the total fees paid by you in the 12 months preceding the claim.

11. Termination

You may close your account at any time by contacting us. We may suspend or terminate your access to the Service if:

  • You breach these Terms
  • Your use of the Service poses a security risk
  • We are required to do so by law
  • We discontinue the Service (with reasonable notice)

Upon termination, we will provide you with a reasonable opportunity to export your data.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the platform at least 30 days before they take effect. Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
